Terms of Service

Last updated: 22 October 2026

These terms are an agreement between GymClub (“we”, “us”) and the gym business that uses GymClub (“Customer”, “you”). By signing up or using GymClub, you accept them on behalf of your business. If you have a signed order form or agreement with us, it takes priority where it differs.

1. The service

GymClub is web-based software for running a gym: memberships, payments and invoices, check-in, enquiries, WhatsApp messaging, staff tools, inventory, reports and AI features. We keep improving it, so features change over time. We will give you notice before removing a feature you pay for.

2. Accounts and staff access

You are responsible for the staff accounts you create, the roles you give them, keeping sign-in details secure, and everything done under your account. Tell us promptly at hello@gymclub.fitness if you suspect unauthorised access.

3. Your data

  • You own the data you put into GymClub, including your members’ data (“Customer Data”).
  • You let us process Customer Data only to provide, secure and support the service, as set out in our Privacy Policy.
  • You are responsible for having the right to collect it: telling members how you use their data, getting their consent where the DPDP Act requires it, and getting a parent’s or guardian’s consent for members under 18.
  • You can export your data while your account is active, and on request when it ends.

4. WhatsApp messaging

Messages are sent through Meta’s WhatsApp Business Platform. You must have members’ opt-in where WhatsApp’s policies require it, use approved message templates, and follow WhatsApp’s Business and Commerce Policies. Meta may charge for messages; how these charges are billed is set out in your plan.

5. AI features

Techie and admission-form scanning use AI and can make mistakes. Check AI output, especially scanned forms and anything involving money, before relying on it. Techie asks for confirmation before money actions; you are responsible for the actions your staff confirm.

6. Fees

Fees are as shown on our pricing page or agreed in your order, and exclude taxes such as GST unless stated otherwise. Unless agreed otherwise, we bill monthly. If an invoice stays unpaid after we remind you, we may suspend the account until it is paid.

7. Acceptable use

You must not use GymClub to:

  • break the law or anyone’s rights, including privacy and consumer-protection law;
  • send spam or messages people did not agree to receive;
  • try to access another gym’s data, bypass security or disrupt the service;
  • copy, resell or reverse-engineer the software, except where the law allows;
  • upload malware or content you have no right to share.

8. Availability and support

We work to keep GymClub available and back up data regularly, but we cannot promise the service will be uninterrupted or error-free. We try to schedule planned maintenance outside gym peak hours. Support is by email and WhatsApp.

9. Ending the service

You can stop using GymClub at any time; there is no lock-in. We may suspend or end your access if you break these terms, do not pay, or put the service or other customers at risk, giving notice where reasonable. When your account ends, we provide an export of your data on request and then delete it as described in the Privacy Policy.

10. Ownership

We own the GymClub software, brand and documentation. While your subscription is active, you get a non-exclusive, non-transferable right to use it for your gym business. If you send us feedback, we may use it freely.

11. Confidentiality

Each of us will keep the other’s non-public business information confidential and use it only for this agreement.

12. Disclaimers

To the extent the law allows, GymClub is provided “as is”. Reports, GST invoices, Tally exports and other outputs help you run your business but are not tax, legal or accounting advice; you remain responsible for your filings and decisions.

13. Limitation of liability

Neither of us is liable for indirect or consequential losses, such as lost profits. Our total liability for any claim relating to GymClub is limited to the fees you paid us in the 12 months before the claim. These limits do not apply to fraud or to anything the law does not allow to be limited.

14. Indemnity

You will cover our reasonable losses from third-party claims caused by your Customer Data, or by messages you send to members without the consent the law or WhatsApp requires.

15. Changes to these terms

We may update these terms. We will post the new version here and, for significant changes, tell you by email or in the app before they take effect. Using GymClub after that means you accept the update.

16. Law and disputes

These terms are governed by the laws of India. We will first try to settle any dispute by talking; if that fails, the courts with jurisdiction over our registered office will decide it.
